Terms & Conditions of Trading
Champion Shotz & Champion Shotz Skoolz
Effective date: 1/1/2025
1. Definitions
1.1 “Client” means the person, school, club, organisation or parent/guardian placing an order for services or goods with Champion Shotz.
1.2 “Service(s)” means photography services (including team-photography, school-portrait photography, drone imagery, 360° tours, floor plans) provided by Champion Shotz.
1.3 “Goods” means physical prints, digital files, interactive media, gift-items or other deliverables purchased from Champion Shotz.
1.4 “Contract” means any agreement between Champion Shotz and the Client for the provision of Services and/or Goods incorporating these Terms & Conditions.
1.5 “Price” means the total fee payable by the Client for the Services and/or Goods under the Contract, excluding VAT unless stated otherwise.
2. Applicability
2.1 These Terms & Conditions apply to all Contracts for the supply of Services and/or Goods by Champion Shotz to the Client to the exclusion of any other terms that the Client may seek to impose or incorporate.
2.2 By placing an order, the Client agrees to these Terms & Conditions. Acceptance of delivery of the Goods or commencement of the Services shall constitute acceptance of these Terms & Conditions.
3. Quotations, Booking & Payment
3.1 Quotations provided by Champion Shotz are valid for [30] days from the date of issue unless otherwise stated.
3.2 A booking (school day, club photo day or other) is secured once the Client pays any required deposit and the date is confirmed in writing (email).
3.3 Payment of the Price (or deposit as specified) must be received by Champion Shotz in the manner specified before commencement of the Services (or before delivery of Goods) unless otherwise agreed in writing.
3.4 All Prices are quoted in UK £ and, unless otherwise stated, are exclusive of VAT.
3.5 In the case of online ordering of Goods (via the Client or via parents/guardians), full payment must be received before dispatch or download links are activated.
4. Delivery of Services & Goods
4.1 Champion Shotz will endeavour to perform the Services and deliver the Goods by the agreed date(s), subject to the availability of the venue and receipt of any required information, authorisations or materials from the Client.
4.2 Delivery times quoted are estimates only and time shall not be of the essence. Champion Shotz shall not be liable for any delay in delivery or performance.
4.3 Title to the Goods remains with Champion Shotz until full payment has been received. Risk in the Goods transfers to the Client on delivery.
4.4 For digital Goods (downloads, files) the Client must exercise reasonable security safeguards: Champion Shotz accepts no responsibility for unauthorised redistribution or third-party claims once delivered.
5. Client Obligations
5.1 The Client shall provide access to the venue, cooperating staff, clear space, power (if required), pupil/participant data and scheduling information as required.
5.2 For school portrait photography (Champion Shotz Skoolz) the Client must ensure compliance with relevant safeguarding, data protection (UK GDPR / Data Protection Act 2018) and parental/guardian consent policies and provide any necessary permissions or lists for the shoot.
5.3 The Client shall ensure that all information provided to Champion Shotz (names, teams, year-groups, data) is accurate and complete. Champion Shotz shall not be liable for errors arising from incomplete or incorrect data.
5.4 If the Client fails to fulfil any obligation (including payment of outstanding amounts), Champion Shotz reserves the right to suspend Services or withhold delivery of Goods until such obligations are met.
6. Inspection, Returns & Refunds
6.1 The Client shall inspect Goods upon delivery and notify Champion Shotz in writing of any alleged defect, shortage or damage within 7 days. For defects not reasonably detectable on inspection, written notice must be given within 30 days of discovery.
6.2 If Goods are found to be defective and such defect is due to Champion Shotz’s negligence, Champion Shotz will either (at its option) repair, replace or refund the Price paid for those Goods.
6.3 Subject to clause 6.4, no returns or refunds apply to personalised or made-to-order Goods (e.g., bespoke gift-items with names, customised prints) unless defective.
6.4 For Services (such as photo-days) already provided, no refund is available unless Champion Shotz fails to provide the Services and the Client has complied fully with all obligations (including data supply, venue access).
6.5 Any refunded amount will not include reimbursed costs of delivery, packaging or handling unless agreed in writing.
7. Intellectual Property
7.1 All copyrights, design rights, moral rights and other intellectual property rights in the photographs, designs, proofs, files and other materials produced by Champion Shotz shall remain owned by Champion Shotz or its licensors unless otherwise agreed in writing.
7.2 The Client is granted a non-exclusive, non-transferable licence to use the final delivered images for private and/or club/school use (website, social media, club publications) unless otherwise agreed. Commercial use (such as licensing to third parties) requires a separate written agreement and fee.
7.3 The Client shall not reproduce, alter or permit others to reproduce or alter the images except with prior written consent from Champion Shotz.
8. Limitation of Liability
8.1 Nothing in these Terms & Conditions shall exclude or limit Champion Shotz’s liability for death or personal injury caused by its negligence or for fraud.
8.2 Subject to clause 8.1, Champion Shotz’s total liability to the Client in respect of any Contract shall be limited to the Price paid by the Client under that Contract.
8.3 In no event shall Champion Shotz be liable for any indirect or consequential loss (including loss of profit, revenue, data or reputation) arising out of or in connection with the provision of Services or Goods.
9. Data Protection & Safeguarding
9.1 Champion Shotz follows strict safeguarding protocols: all photographers and assistants engaged by Champion Shotz are DBS/DBS-equivalent checked (where required) and trained in safeguarding children, where applicable (e.g., school portrait sessions).
9.2 Champion Shotz complies with UK GDPR and the Data Protection Act 2018 for all personal data and image files. Data collection, processing, storage and sharing is governed by our separate Privacy & Data Protection Policy.
9.3 For school-portrait work (Champion Shotz Skoolz) the Client must ensure parental/guardian consent is obtained for each pupil and that the data shared with Champion Shotz is secure and sent by secure means. Champion Shotz will use secure platforms for uploading proofs and ordering.
9.4 The Client acknowledges and accepts that image processing, proofing and ordering may involve third-party fulfilment partners – Champion Shotz will ensure such partners are selected on the basis of appropriate security and confidentiality standards.
10. Cancellation & Rescheduling
10.1 If the Client requests cancellation or rescheduling of a booked photo-day, Champion Shotz must receive written notice at least [14] full working days prior to the scheduled date unless otherwise stated.
10.2 If cancellation is requested within [14] working days of the scheduled date, the Client may be liable to pay a cancellation fee (to be specified in the quote).
10.3 Champion Shotz may cancel or postpone the photo-day due to adverse weather, venue issues, equipment failure or other circumstances beyond its control (“Force Majeure”). In such cases, Champion Shotz will endeavour to offer an alternative date. No refund is due if the Services cannot be rescheduled and liability remains limited as per clause 8.
11. Force Majeure
11.1 Champion Shotz shall not be liable for any failure or delay in performing its obligations resulting from causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, civil disturbance, governmental actions, strikes, fire, flood, power failure or internet/telecommunications disruption.
11.2 In such event, Champion Shotz may at its option extend time for performance, cancel the Contract or reduce Services without liability, and the Client shall not be entitled to any claim for losses.
12. Third Party Rights
12.1 A person who is not a party to the Contract shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of the Contract.
13. Amendments & Waiver
13.1 No amendment to these Terms & Conditions shall be effective unless agreed in writing by a director of Champion Shotz.
13.2 Failure or delay by Champion Shotz in enforcing any right or provision under the Contract shall not operate as a waiver of that right or provision.
14. Governing Law & Jurisdiction
14.1 The Contract, these Terms & Conditions and any non-contractual obligations arising thereof shall be governed by and construed in accordance with the laws of England & Wales.
14.2 The parties submit to the non-exclusive jurisdiction of the courts of England & Wales.
